Increasing the rent (section 13)

One increase a year, by notice, with at least two months before it takes effect and a right for the tenant to challenge it.

The rules

  • Rent may be increased once in any 12-month period.
  • Use a section 13 notice — rent review clauses in the agreement can no longer be used to force an increase.
  • Give at least two months' notice before the new rent starts.
  • The increase must be to a market rent for a comparable property.

If the tenant challenges

The tenant may apply to the First-tier Tribunal before the new rent takes effect. The Tribunal cannot set a rent higher than the one you proposed, and the new rent will not begin until the Tribunal decides.

Practical steps

  1. Evidence the market rent with two or three genuine comparables and keep them on file.
  2. Serve the notice on the prescribed form with the correct dates.
  3. Update the tenancy and the rent ledger from the effective date, not the notice date.
  4. Never treat an unpaid increase as arrears until it has legally taken effect.
